These Terms of Service (“Terms”) govern your access to and use of the Home Vitals LLC website and customer portal at homevitalspr.com. Please read them carefully.
By creating an account or using our platform, you agree to these Terms. If you do not agree, do not use our services.
1. About Home Vitals
Home Vitals LLC is an AC cleaning service business operating in Puerto Rico. Our services are limited to the cleaning services described at booking: AC unit cleaning, filter replacement, and visual inspection. Services regulated under Puerto Rico or federal law — including refrigerant handling, electrical work, and plumbing — are performed only when expressly included in your service scope and only by or under the direct supervision of personnel holding the required license or certification.
2. Accounts
- To use the customer portal, you must create an account with accurate, current information. Sign-in is passwordless: access is granted through one-time codes and links sent to your email, so you are responsible for maintaining the security of the email account you register with.
- You may sign in using a one-time code or link sent to your email, or via Google Sign-In. You are responsible for all activity under your account.
- Booking with or without an account. For one-time services you may create a portal account or continue as a guest. As a guest, we handle your booking, payment, and any documents to sign by email, and your service report and benefits remain available if you create an account later. Subscription plans require a portal account so you can manage your recurring visits, payments, and documents; an account is created for you when you enroll.
- We reserve the right to suspend or terminate accounts that violate these Terms or for non-payment.
3. Services and Scheduling
- Service availability is subject to technician availability and our geographic coverage area (island-wide service, based in Fajardo, PR).
- Automated scheduling. To match you with an available technician as efficiently as possible, our platform uses an automated scheduling system. By booking a service or enrolling in a subscription, you authorize Home Vitals to select your appointment date and time window and to coordinate an available technician based on availability and proximity to your service address. When our schedule allows, we may propose a time for your confirmation; when demand is high, we may schedule the next suitable available time automatically. We will notify you of any scheduled, rescheduled, or automatically assigned appointment.
- Appointment times are estimates, not guarantees. Scheduled times are good-faith estimates and may be given as arrival windows. The duration of a job varies with the number and condition of units and on-site conditions, so actual start and finish times may differ. We may reschedule when necessary — including for weather, access problems, or a prior job running long — and will give you notice. We are not liable for delays caused by circumstances beyond our reasonable control.
- Service Agreement signed at booking. When you complete a booking you review and electronically sign a Service Agreement that incorporates these Terms and describes the service, the all-in price (IVU included), and the scope of work. One-time services are signed by typing your full legal name and checking a consent box; subscription plans are signed using a one-time verification code sent to your email. We record your signature, the date and time, your IP address, and the exact text you agreed to. A job will not begin without a confirmed signature.
- Authorization for additional or concealed work. The Service Agreement you sign at booking covers only the service and scope described at that time. If a concealed, pre-existing, or additional condition is discovered on-site (e.g., mold, electrical damage, refrigerant issues) that falls outside that scope, you will be notified and a separate authorization (a change order) must be reviewed and signed before that additional work proceeds. We may pause or decline work that falls outside our authorized scope (see Section 1).
- Our technicians will document the service with photos and a written inspection report.
- We are not liable for pre-existing conditions or damage discovered during inspection that was not caused by our service.
4. Pricing and Payment
- Service pricing is as listed on our platform at the time of booking. Prices are subject to change with reasonable notice.
- Puerto Rico IVU (sales tax) of 11.5% applies to all services and will appear as a separate line item on your invoice. This is a government-mandated tax we collect on behalf of Hacienda PR.
- Payments are processed securely through Stripe. We accept major credit/debit cards. ATH Móvil payments are handled as manual cash entries.
- Subscription plans, if applicable, are billed on a recurring basis per your selected plan. Plans require a minimum of 2 completed visits before cancellation; see Section 5 for full cancellation terms.
- Refunds are handled on a case-by-case basis. Contact us within 7 days of service if you believe there is an issue with the work performed.
5. Subscription Plans & Automatic Renewal
If you enroll in a subscription plan:
- Services are provided at the frequency specified in your plan.
- Minimum commitment. Each subscription plan requires a minimum of 2 completed service visits before you may request cancellation of the plan. This commitment is disclosed at sign-up and applies to each new enrollment. After the 2-visit minimum is satisfied, you may cancel at any time with at least 15 days' written notice before your next scheduled visit.
- Plan benefits. Discounts on repairs and other plan benefits apply while your plan is active and the 2-visit minimum has been met. The plan covers the residence on file only.
- Automatic renewal. Your plan renews automatically for successive periods of the same length unless cancelled. Consistent with Puerto Rico's Automatic Renewal of Services Act (Act 122 of 2017), the renewal terms are disclosed to you at sign-up and we will notify you before each renewal. After the 2-visit minimum is satisfied you may cancel at any time with the required notice.
- Renewal scheduling and your right to choose a date. When a renewal service period opens, we will create your upcoming visit and invite you, by email, to choose the date that works best for you. If you do not choose a date, you authorize Home Vitals to schedule the visit on your behalf — by default approximately 14 days before your service due date — so your service is not missed. We will notify you of the assigned date, and you may reschedule or cancel that visit at no charge.
- Cancellation after minimum. Once the 2-visit minimum is met, you may cancel your plan through your portal or by contacting us, with at least 15 days' notice before the next visit. You may reschedule or cancel any individual visit at any time at no charge. Prepaid periods are non-refundable except at our discretion.
- We reserve the right to modify plan pricing at renewal with at least 30 days' written notice.
6. Communications & Notifications
By creating an account, booking a service, or enrolling in a subscription, you consent to receive service-related communications from Home Vitals — including booking confirmations, scheduling and rescheduling notices, requests to choose an appointment date, appointment reminders, work authorizations, invoices, and receipts — by email and, where you provide a mobile number, by SMS or WhatsApp. These are transactional messages necessary to provide the service; message and data rates may apply. You may opt out of non-essential or marketing messages at any time (for example, by replying STOP to texts or using the unsubscribe link in emails), but you may still receive essential messages about your account and scheduled visits. Electronic confirmations and authorizations recorded through our platform are valid and enforceable under the Puerto Rico Electronic Transactions Act (Law No. 148 of 2006) and the federal ESIGN Act.
7. Contractor Relationships
Our field services are performed by independent contractors, not employees of Home Vitals LLC. Each contractor signs an Independent Contractor Agreement and must carry the certifications and insurance required to perform the services. Contractors set their own availability and accept service opportunities at their own discretion; Home Vitals establishes service-quality standards and the result to be achieved, but does not control the manner, means, or methods by which a contractor performs the work. This arrangement does not create an employment, agency, or partnership relationship.
8. Intellectual Property
All content on homevitalspr.com — including the Home Vitals name, logo, service reports, and platform design — is the property of Home Vitals LLC and may not be copied, reproduced, or used without written permission.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Home Vitals LLC shall not be liable for indirect, incidental, special, or consequential damages arising from your use of our services or platform. Our total liability for any claim shall not exceed the amount you paid Home Vitals for the specific service giving rise to the claim.
10. Disclaimer of Warranties
Our services and platform are provided “as is.” We make no warranty that the platform will be uninterrupted or error-free, or that service results will meet any specific outcome (e.g., a specific percentage reduction in your electric bill).
11. Governing Law
These Terms are governed by the laws of the Commonwealth of Puerto Rico and applicable federal law. Any disputes shall be resolved in the courts of Puerto Rico, with venue in the judicial district covering Fajardo, PR.
12. Changes to These Terms
We may update these Terms at any time. Continued use of the platform after changes are posted constitutes your acceptance. Material changes will be communicated via email or a notice on the platform.
